Power of Attorney for Iranians Abroad: Comprehensive Guide
Power of Attorney for Iranians Abroad: Comprehensive Guide
Managing Legal Affairs and Litigation from Outside Iran
Handling legal matters, filing lawsuits, or defending claims in Iranian courts without physical presence is a primary concern for Iranians living abroad. For this purpose, drafting a consistent and legal Judicial Power of Attorney is the most critical step. In this specialized guide by Raahesh, we provide a comprehensive review of methods for setting up litigation power of attorney via official systems.
What are Judicial, Litigation, and Court-Appointed Power of Attorney?
When an Iranian living abroad intends to hire a lawyer in Iran to pursue legal matters, they have two fundamental legal options, each with its own technical requirements.
1. Judicial Power of Attorney via the Judiciary’s “Sana” System
Individuals previously registered in the Sana System can sign a formal contract with a lawyer completely remotely, online, and using an electronic signature (via SMS confirmation). This method is highly simple and efficient, requiring no additional consular fees.
2. Judicial Power of Attorney via the MFA’s “Mikhak” System
If an Iranian living abroad, for any reason, lacks access to the Sana system, they can still hire a lawyer. In this case, the principal logs into the Mikhak System to grant power directly to a trusted intermediary (such as a parent) or directly to a lawyer to organize and register the court-appointed contract in Iran.
In this Mikhak method, one can delegate to a trusted proxy the authority to select a qualified defense attorney in Iran and sign electronic contracts on the principal’s behalf.
